GBIC comments on EBA’s draft Guidelines of credit servicers

The guidelines are intended to ensure that the executive bodies are capable of managing the credit service provider's business competently and responsibly.

The European Banking Authority (EBA) launched a public consultation in April 2023 on its draft Guidelines on the assessment of adequate knowledge and experience of the management or administrative organ of credit servicers, as a whole, under the Non-Performing Loans Directive. The Guidelines aim at ensuring that the organs are suitable to conduct the business of the credit servicer in a competent and responsible manner. GBIC points out in its comments that the scope of qualification of a credit servicer should be aligned with the relevant business model. Besides, a standardised structure in terms of supervisory law should be established.
